Terms and Conditions

These general terms and conditions apply to the chartering of an aircraft from Opus Jets to an individual person, company or agent (the ‘client’), to the exclusion of all other terms, conditions, warranties and representations, except any specifically agreed by parties in writing. Please read them carefully as they describe our and your rights and obligations.

1. Definitions

1.1 Opus Jets - shall mean Jet Escapes Ltd trading as Opus Jets
1.2 You’ and ‘Your’ - means all persons named on the Booking Confirmation (including anyone who is added or substituted at a later date)
1.3 The Aircraft - shall mean any aircraft which is used by Opus Jets to fulfill the client’s booking
1.4 The Carrier - shall mean the air operator whose aircraft is/are being used to fulfill the client’s booking and any of its staff or assigns
1.5 Booking Confirmation - shall mean the document issued by Opus Jets containing the initial flight sectors confirmed as part of the booking
1.6 Flight Schedule - shall mean the designated places of departure, arrival and any stopping points as well as any departure and arrival times agreed between Opus Jets and the client.

2. To make a booking

2.1 To confirm a booking you must sign the Booking Confirmation. By signing the Booking Confirmation you guarantee that you are authorised to make the booking on behalf of all persons named on the Booking Confirmation and that you accept the terms of these conditions on behalf of your party. You must be 18 years of age or above at the time the booking is made. The person signing the Booking Confirmation is responsible for making all payments due to Opus Jets. On issue of the Booking Confirmation a binding contract between us comes into existence and both you (the client) and Opus Jets will be bound by these terms and conditions.

2.2 Once we have received your signed Booking Confirmation we will, subject to availability, confirm all flight sectors as itemised on your Booking Confirmation. Please check the Booking Confirmation as soon as you receive it. Contact us immediately if any information is incorrect or incomplete as it may not be possible to make changes later. We regret we cannot accept liability of any inaccuracy on the Booking Confirmation within 48 hours of receipt. We will do our best to rectify any mistake notified to us outside the time limit but you must meet any costs incurred in doing so. The only exception to the requirement to meet costs is where the mistake in question was made by Opus Jets.

3. Deposits and balance of payment

3.1 A deposit of 20% of the total price is required to confirm your booking.

3.2 The balance must be received by us not less than 21 days before your departure date. If the booking is made within 21 days of the date your arrangements are due to commence, the full cost must be paid at the time of the booking.

3.4 If the deposit and/or balance are not paid in time, we shall cancel your travel arrangements. If the balance is not paid in time we shall retain your deposit. Exchange rates used to calculate the cost of your charter are as follows: €1.10, Sw Fr 1.60, US$ 1.40. Your charter may be subject to surcharges for increases in transportation costs and currency changes, but if this surcharge means that you have to pay more than 10% of the price of your original travel arrangements, you may cancel and receive a full refund.

4. Opus Jets rights and obligations

4.1 Opus Jets will provide an aircraft for the client fully manned, equipped and fuelled to carry out the flight schedule as set out in the Booking Confirmation. The aircraft referred to in the Booking Confirmation may be subject to change provided the replacement aircraft is of a similar or superior standard. This is deemed as a minor change and no compensation will be payable.

4.2 Should the confirmed aircraft become unavailable for any reason (whether before or after the commencement of the Flight Schedule) Opus Jets will use its best endeavours to source another suitable carrier at the same price. Should this prove to be impossible Opus Jets will use its best endeavours to source an alternative carrier at as close a price as possible and you shall be liable to pay the increased charter price. In the unlikely event that one or more flight sectors of your journey become non operational for any reason and it is not possible to replace the aircraft with a similar private jet we reserve the right to provide you with scheduled airline transportation for that sector within the highest class available. We will refund the difference in price.

4.3 Whilst we always eandeavour to avoid changes to your booking, we must reserve the right to do so but they will be minor and no compensation will be payable. For example: alteration of your outward/return flights by less than 6 hours or the change of an airport for operational reasons or inclement weather.

4.4 If we are unable to provide the booked travel arrangements (eg because of bad weather), you can either have a refund of all monies paid or accept an offer of alternative travel arrangements of comparable standard from us (we will refund any price difference if the alternative is of a lower value). The alternative arrangements will be subject to availability.

4.5 If we have to make a major change to your charter, we will inform you as soon as possible. If this happens you will have the choice of either accepting the change of arrangements, accepting an offer of alternatives (we will refund any price difference and the alternative arrangements will be subject to availability), or cancelling and receiving a full refund of all monies paid.

4.6 We reserve the right to cancel your travel arrangements but will not do so within 7 days of departure, except for reasons of force majeure (see clause 8) or failure by you to pay the balance.

4.7 If any of your party has a medical problem or disability which may affect your arrangements or has any special requirements as a result of any medical condition or disability please tell us before you confirm your booking so that we can assist you in considering the suitability of your chosen aircraft or arrangements. If we feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline their reservation or, if full details are not given at the time of the booking or the condition/disability develops after booking, cancel when we become aware of these details.

4.8 If you find you are running late please contact us as soon as possible. However should you fail to arrive at your chosen airport within 2 hours of your departure and without contacting us to advise of your late arrival, it will be considered that you no longer require the service, your flight will be cancelled and you will not be entitled to any refund or replacement service. If you contact us and request a deferred departure time, you are liable for any costs incurred if we are able to make the alteration.

5. Client obligations

5.1 You must provide all information in respect of all passengers to allow the booking to be made and Travel Documents to be produced.

5.2 You must ensure that you and your passengers have all necessary identity documents, visas, health certificates and other documentation required by the authorities of the countries of departure, transit and arrival.

5.3 You and your and party shall arrive at the designated place of departure by the designated time as set out in the final Travel Documents and the carrier reserves the right for the aircraft to depart as scheduled whether or not all passengers are on board the aircraft.

5.4 Should you or any of your passengers fail to arrive at the scheduled check-in time, you shall be liable to pay any costs arising from and incidental to the delay. Such costs may include, but shall not be limited to time-slot delays, additional hangerage, aircraft parking and other additional airport charges as well as crew and pilot expenses for accommodation and refreshments as a result of such delay.

5.5 You acknowledge that the aircraft is provided for ‘sole use’ and shall under no circumstances sub-charter the aircraft.

5.6 You acknowledge that the Captain of the aircraft shall have absolute discretion when taking decisions concerning the operation of the aircraft in order to ensure the safety of the aircraft, the passengers, the crew and any cargo.

5.7 You shall ensure that no damage is caused to the aircraft by any of your passengers and agree to accept full responsibility for any costs associated with and incidental to the repair of any such damage.

5.8 You must ensure that all luggage is properly and sufficiently packed for carriage (soft sided luggage is preferred) and will not contain anything of a dangerous, hazardous or offensive nature of which the carriage, importation or exportation is prohibited by any country or state which has been crossed or entered. Acceptance of baggage rests solely with the Captain(s) of the charter aircraft. Opus Jets shall not be liable for any loss or damage to baggage however caused. The quantity and volume of luggage should always be a major consideration when choosing your aircraft and Opus Jets will advise you accordingly at the time of booking.

6. If you need to change or cancel your charter

6.1 Requests for changes must be in writing from the person who made the booking. We will always try to accommodate any changes you make to your booking; however you are liable for any costs incurred if we are able to make the alteration.

6.2 You may cancel your travel arrangements at any time. Cancellation must be in writing from the person who made the booking.

6.3 Please note that the aircraft is chartered as a ‘whole’ and should one or more members of your party cancel, the total price still remains the same.

6.4 Should you decide to curtail your itinerary for any reason, or decide not to use booked services, no refunds will be given.

7. Bad weather and Air Traffic Control

Bad weather is beyond anyone’s control and you shall be liable for all costs incurred by Opus Jets as a result of delays and/or re-routes from inclement weather or Air Traffic Control instructions, including extra flying time where applicable. This includes de-icing of aircraft. Where, in these circumstances, the aircraft is obliged to land at a different airport to the airport stated in the Booking Confirmation, Opus Jets shall be under no obligation to transport you to your intended destination.

8. Force Majeure

We regret we cannot accept liability or pay any compensation if we are prevented from fulfilling any part of the charter as a result of ‘force majeure’ (any event in which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid). These include strikes, lockouts, inclement weather, war or threatened war, terrorist activity (actual or threatened), riot, demonstration, fire, flood, earthquake, any other Act of God, any order of a court or government, or for any other similar event outside of our control.

9. Problems and complaints

9.1 If you have a problem with your charter, please call us on the emergency number provided. If you fail to follow this simple procedure, we cannot accept responsibility for any problem or complaint that could have been rectified had you notified us or the supplier at the time. Failure to comply with this simple procedure may mean that your right to claim any compensation you may otherwise have been entitled to may be affected or even lost as a result.

9.2 If we cannot resolve the problem immediately, please follow this up within 28 days of your return home by writing to us. Disputes arising out of this contract which cannot be settled amicably may be referred to arbitration with an independent arbitrator appointed by the Chartered Institute of Arbitrators.

10. Liabilities

10.1 Opus Jets acts only as a broker for all travel arrangements set out on your Booking Confirmation.

10.2 We accept responsibility for ensuring that your charter is supplied as described in your Booking Confirmation. If your charter is not provided as promised due to the fault of our employees or suppliers we will pay you appropriate damages as might have been awarded in such circumstances under English Law.

10.3 In respect of travel by air our liability and our Carrier’s liability will be limited in the manner provided by the relevant international convention

10.4 Subject to these booking conditions we will accept responsibility if, for example, you suffer death or personal injury or your contracted arrangements are not provided as promised or prove deficient as a result of the failure of ourselves, our employees or suppliers to use reasonable skill and care in making, performing or providing, as applicable, your contracted arrangements.

10.5 We will not be responsible for any injury, illness, death, loss (including loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:-
• The acts and/or omission(s) of the persons(s) affected or any member(s) of their party or
• The act(s) and/or omissions of a third party not connected with the provision of your arrangements and which were unforeseeable or unavoidable or
• Force Majeure as defined in clause 8
